Is there any way to force old 3DS to have Circle Pad Pro enabled all the time and use ReHID with it?

So is there a homebrew/patch to force IR to always be on and force Circle Pad Pro to be on for all games? I kind of want to use Loopy's Controller board and ReHid to assign the extra buttons for touch.
